Terms of Service

These Terms of Service govern your access to and use of RakBaan. RakBaan provides technology that helps consumers, agencies, agents, and landlords connect and manage property activity. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.

Definitions

"Service" means RakBaan's websites, mobile apps, APIs, marketplace, CRM, agency-management tools, and related services. "User" means any person or organisation that visits, accesses, or uses the service. "Content" includes listings, images, messages, reviews, profile information, documents, lead data, and other materials submitted or made available through the service.

Acceptance

These terms apply to all visitors, registered users, agencies, agents, customers, and organisations that access or use the service. Additional commercial terms may apply to specific plans, pilots, or enterprise agreements.

Accounts

  • You must be legally capable of entering into a binding agreement and at least 18 years old to create or administer an account.
  • You are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account, except where caused by our own failure.
  • We may require agencies, agents, landlords, or business users to complete verification, KYC, ownership, authority-to-list, or eligibility checks before certain features are enabled.

Subscriptions and billing

Paid features, plans, trials, renewals, and billing cycles may be offered to agencies or other business users. Fees, taxes, billing dates, refunds, and cancellation rules may be governed by the plan selected, any order form, and the payment provider used to process charges.

Content and listings

  • You are responsible for ensuring that content you submit is accurate, current, lawful, non-infringing, not misleading, and that you have all rights, licences, authority, and permissions needed to publish or manage it.
  • You grant RakBaan a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, and display your content as needed to operate, secure, improve, and promote the service.
  • We may review, reject, suspend, or remove content that breaches these terms, our policies, third-party rights, or applicable law.

Marketplace and listing responsibility

  • Unless expressly stated otherwise in a separate written agreement, RakBaan provides software, CRM, agency-management, and marketplace infrastructure. RakBaan is not a broker, real-estate agent, landlord, property manager, attorney, valuer, lender, escrow provider, payment intermediary, insurer, or party to any property transaction between users.
  • Listings, availability, prices, descriptions, images, ownership claims, legal status, measurements, permissions, deposits, payment requests, contract terms, and transaction terms may be supplied by users or third parties and must be independently verified before you rely on them or transfer money.
  • Any viewing, negotiation, payment, contract, tenancy, sale, purchase, commission arrangement, or dispute between users or third parties is their own responsibility, even if the initial contact, enquiry, listing, or content appeared on the service.

Reports, scams, and investigations

  • If you believe a listing, agency, agent, landlord, customer, message, payment request, or other activity is fraudulent, misleading, unsafe, unlawful, or otherwise suspicious, you should report it to RakBaan and avoid making payments or commitments until you have completed your own checks.
  • We may review reports, request further information, contact relevant parties, restrict features, remove content, suspend accounts, preserve records, or cooperate with authorities where we consider it appropriate.
  • If an agency, agent, landlord, or other user is found by us to be scamming, acting fraudulently, materially misleading users, or creating serious safety or trust risks, we may remove listings, eject the user or agency from the platform, and take any other action available to us.
  • Our review, verification, moderation, or enforcement activity does not make RakBaan responsible for user conduct, third-party content, property transactions, user losses, or scams committed by other users or third parties.

Prohibited use

  • Do not misuse the platform, including attempting to disrupt service availability.
  • Do not post fraudulent, misleading, unavailable, unauthorised, duplicated, bait, illegal, or materially inaccurate listings, and do not request payments or deposits in a dishonest or unsafe manner.
  • Do not scrape, copy, or harvest data without permission.
  • Do not attempt to bypass security or access restricted systems.
  • Do not send spam, unsolicited messages, or abusive communications.
  • Do not harass, threaten, or discriminate against other users.

Intellectual property

RakBaan and its licensors retain all rights, title, and interest in the service, software, branding, design, and materials we provide, excluding user content and third-party content owned by others.

Disclaimer

The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, listing accuracy, user identity, user authority, property availability, property condition, legal compliance by users, successful enquiries, transaction outcomes, or that the service will detect every scam, misrepresentation, or unlawful act.

Limitation of liability

To the fullest extent permitted by law, RakBaan will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, opportunities, deposits, payments, rent, purchase funds, commissions, travel costs, relocation costs, or other losses arising from your use of the service, reliance on listings or third-party content, communications with users, property viewings, contracts, payments, disputes, scams, fraud, or transactions between users or third parties.

Termination

We may suspend or terminate access, including agency and agent workspaces, for violations of these terms, suspected or confirmed fraud, safety concerns, legal risk, non-payment, misuse, or to protect users and the platform.

Suspension and enforcement

We may restrict access, remove listings or content, hide profiles, limit features, block communications, cancel subscriptions, or eject agencies, agents, landlords, or other users where we believe it is necessary to enforce these terms, investigate reports, protect users, protect RakBaan, or comply with law.

Indemnity

You agree to defend, indemnify, and hold RakBaan and its affiliates, officers, employees, contractors, and service providers harmless from claims, losses, damages, liabilities, costs, and expenses arising out of your content, listings, enquiries, communications, transactions, payments, property activity, use of the service, breach of these terms, fraud, misconduct, or violation of law or third-party rights.

Dispute resolution

We encourage parties to first try to resolve disputes informally by contacting us. If that does not resolve the issue, disputes will be handled in accordance with the governing law and any mandatory rights or procedures that apply.

Governing law

These terms are governed by the laws applicable in Thailand unless otherwise required.

Changes to these terms

We may update these terms periodically. Continued use of the service means you accept the updated terms.
